What are Illinois harassment compliance training requirement?
Effective January 1, 2020, The Workplace Transparency Act requires all employers in Illinois to provide sexual harassment training to all employees every year. The Illinois Legislature said in the law that “organizational tolerance of sexual harassment has a detrimental influence in workplaces by creating a hostile environment for employees, reducing productivity, and increasing legal liability” and that it was their “intent to encourage employers to adopt and actively implement policies to ensure their workplaces are safe for employees to report concerns about sexual harassment without fear of retaliation, loss of status, or loss of promotional opportunities.”
The training must:
- Explain that sexual harassment violates state and federal law;
- Define sexual harassment;
- Discuss the types of conduct that may constitute sexual harassment under the law;
- Describe the remedies available in sexual harassment cases;
- Explain the responsibility of employers to prevent, investigate, and correct sexual harassment.
Bars and restaurants must provide additional training covering:
- specific conduct related to the restaurant or bar industry; and
- an explanation of manager liability and responsibility under the law.
When do I have to train new employees?
New hires must be trained in the first 90 days of employment.
What are the penalties for employers who do not provide training?
Employers who do not provide the required training can be fined, with penalties ranging from $500 to $5,000 per violation.
